1. Introduction
These Terms of Use ("Terms") govern your access to and use of Pocket Sergeant, including our mobile applications, website and any associated services (collectively referred to as the "Service").
By downloading, accessing or using Pocket Sergeant, you agree to be bound by these Terms. If you do not agree to these Terms, you must not use the Service.
We may update these Terms from time to time. Any changes will take effect once published on our website or within the Service. Your continued use of Pocket Sergeant after any changes have been published constitutes acceptance of the updated Terms.
2. About Pocket Sergeant
Pocket Sergeant is an independent digital policing platform designed to provide police officers, police staff, Special Constables, PCSOs, criminal justice professionals, students and other users with quick access to legislation, police powers, operational guidance and reference material.
Pocket Sergeant is an independent commercial product and is not affiliated with, endorsed by, authorised by or acting on behalf of the UK Government, the Home Office, any police force, the College of Policing, the Police Digital Service or any other public authority.

3. Use of the Service
Pocket Sergeant is provided as a reference and educational resource to assist users in locating information quickly.
The Service is intended to support informed decision-making but does not replace professional judgement, force policies, operational training, legal advice or supervisory direction.
You remain responsible for ensuring that any decisions you make are based upon current legislation, applicable force policies and your own professional judgement.
4. User Accounts
Certain features of Pocket Sergeant may require you to create an account.
You are responsible for maintaining the confidentiality of your login credentials and for all activity that occurs under your account.
You must notify us promptly if you believe your account has been accessed without your permission.
5. Subscriptions and Billing
Pocket Sergeant is available through recurring subscriptions purchased via Apple App Store, Google Play or other authorised platforms.
Where available, eligible new subscribers may receive a free trial.
Unless cancelled before the trial period ends, your subscription will automatically convert to a paid subscription and continue to renew automatically until cancelled.
Subscription charges, billing and refunds are managed by the relevant app store and are subject to their respective terms and conditions.
Deleting the application does not cancel your subscription.
We reserve the right to change subscription pricing. Where required, reasonable notice will be provided before any price changes take effect.
6. Commercial Use
Unless otherwise agreed in writing, Pocket Sergeant subscriptions are licensed for individual personal use only.
Police forces, businesses, educational institutions or other organisations wishing to provide Pocket Sergeant to multiple users must obtain an appropriate commercial or enterprise licence.
Unauthorised commercial use may result in suspension or termination of access.
7. Acceptable Use
When using Pocket Sergeant, you agree that you will not:
* share your account or subscription with another person;
* copy or reproduce substantial parts of the Service or its content;
* reverse engineer, decompile or attempt to extract source code;
* use automated software to scrape or extract information;
* interfere with the operation or security of the Service;
* upload malicious software or code;
* use the Service for unlawful purposes; or
* misuse the Service in any way that could negatively affect Pocket Sergeant or other users.
Failure to comply with these Terms may result in suspension or permanent termination of your account.
8. Disclaimer
Pocket Sergeant is intended solely as a reference and educational tool.
Whilst we make every reasonable effort to ensure the information contained within the Service is accurate and up to date, legislation, statutory guidance, case law and policing practices change regularly.
Accordingly, we cannot guarantee that all information will always be accurate, complete or current.
Nothing contained within Pocket Sergeant constitutes legal advice, operational advice or professional advice.
Users remain responsible for verifying important information using official legislation, force policies and other authoritative sources where appropriate.
Where local force policies differ from information contained within Pocket Sergeant, the relevant organisational policy shall take precedence.
9. Artificial Intelligence
Where Pocket Sergeant provides AI-powered features, responses are generated using artificial intelligence and are intended to provide general guidance only.
AI-generated content may occasionally be inaccurate, incomplete or out of date and should not be relied upon as legal advice or official guidance.
Users should independently verify important information before relying upon AI-generated responses.
10. Intellectual Property
Pocket Sergeant and all associated software, databases, branding, logos, graphics, designs, text and original content are protected by copyright, trade mark and other intellectual property laws.
Except where permitted by law or with our prior written consent, you may not reproduce, distribute, modify, reverse engineer, commercially exploit or create derivative works from any part of the Service.
Content reproduced under the Open Government Licence remains subject to Crown copyright and the terms of that licence.
All other trade marks remain the property of their respective owners.
11. Third-Party Services
Pocket Sergeant may contain links to third-party websites, services or applications.
These third-party services operate independently of Pocket Sergeant.
We are not responsible for their content, availability, security or privacy practices, and your use of such services is entirely at your own risk.
12. Availability
We aim to provide reliable access to Pocket Sergeant but do not guarantee uninterrupted availability.
The Service may occasionally be unavailable due to maintenance, software updates, technical issues, third-party service interruptions or events beyond our reasonable control.
We reserve the right to modify, suspend or discontinue any part of the Service where reasonably necessary.
13. Suspension and Termination
We reserve the right to suspend or terminate your access to Pocket Sergeant where we reasonably believe that:
* these Terms have been breached;
* fraudulent or unlawful activity has occurred;
* your account has been used inappropriately; or
* continued access presents a security or operational risk.
Termination does not affect any legal rights or obligations that arose before termination.
14. Limitation of Liability
To the fullest extent permitted by law, Pocket Sergeant, its owners, employees, contractors and representatives shall not be liable for any direct, indirect, incidental or consequential loss arising from your use of, or inability to use, the Service.
This includes, without limitation:
* loss of profits;
* loss of income;
* business interruption;
* operational decisions;
* disciplinary outcomes;
* prosecution outcomes;
* loss of data;
* damage to equipment; or
* third-party claims.
Nothing in these Terms excludes or limits liability that cannot lawfully be excluded, including liability for death or personal injury caused by negligence or your statutory rights as a consumer.

Your use of Pocket Sergeant is also governed by our Privacy Policy, which explains how we collect, use and protect your personal information.
By using Pocket Sergeant, you acknowledge that you have read and understood our Privacy Policy.
16. Changes to the Service
We continually develop and improve Pocket Sergeant.
We may add, modify, replace or remove features, functionality or content at any time to improve the Service, comply with legal obligations or maintain security and performance.
